AGREEMENT TO OUR LEGAL TERMS
These Terms of Use constitute a legally binding agreement between you ("you") and LUMARYX LLC ("Company," "we," "us," or "our") governing your access to and use of www.lumaryx.com and any related services (the "Services"). If a dispute cannot be resolved informally, it shall be resolved exclusively in the state or federal courts located in California, and you consent to the jurisdiction of such courts.

11. DISCLAIMER
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
We make no warranties regarding accuracy, completeness, or availability.
12. LIMITATION OF LIABILITY
To the fullest extent permitted by law, LUMARYX LLC shall not be liable for any indirect, incidental, or consequential damages, including loss of profits, data, or business opportunities.
Our total liability shall not exceed one hundred U.S. dollars ($100) in the six (6) months preceding the event giving rise to the claim.
13. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless LUMARYX LLC from and against any claims, damages, losses, liabilities, and expenses, including reasonable attorneys’ fees, arising out of or related to:

14. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically and agree that they satisfy legal requirements.
15. MISCELLANEOUS
These Terms constitute the entire agreement between you and LUMARYX LLC.
If any provision is held unenforceable, it shall be modified to the minimum extent necessary to be enforceable, and the remaining provisions shall remain in full effect.
Our failure to enforce any provision shall not operate as a waiver of that provision or any other provision.
